Terms of Service

By using Byahe Builder (“the app”), you agree to these terms. If you don’t agree, please don’t use it.

We’re a small project trying to make trip planning in the Philippines easier. These terms are kept short and plain — please read them.

Your account

You’re responsible for keeping your password safe.
One person, one account. Don’t share accounts.
You can delete your account anytime — see the Privacy Policy for how.
We may suspend accounts that violate these terms or harm other users.

Acceptable use

When using the app, please don’t:

Spam, harass, threaten, or impersonate other people
Publish content that’s illegal, hateful, or sexual in nature
Scrape the activity catalog or copy it for a competing service
Try to break, abuse, overload, or reverse-engineer the service
Upload or link to malware, phishing pages, or other harmful content
Use the app in a way that could harm other users or third parties

Your content

You own the trips, custom activities, notes, and descriptions you create. We don’t claim any ownership of your content.

When you publish a trip to the community gallery:

You grant us a non-exclusive, worldwide, royalty-free license to display your trip within the app and let other signed-in users view, copy, and customize it into their own accounts.
This license ends when you unpublish or delete your trip.
You confirm you have the right to share what you publish — for example, you’re not pasting someone else’s copyrighted itinerary as your own.
Personal notes you’ve added to activities are stripped before publishing and never appear on the public version — see the Privacy Policy.

If your content violates these terms, we may remove it without notice.

Activity images and credits

Activity photos in the app come from a mix of sources:

Wikimedia Commons — freely licensed photos (typically CC BY or CC BY-SA)
Pexels — under the Pexels License
Flickr — under a Creative Commons license, or with the photographer’s written permission for All-Rights-Reserved photos
Direct uploads contributed by activity operators or admins, with credit metadata

Credits appear under each photo in the carousel. We make reasonable efforts to verify licensing before using a photo.

If you’re a rights holder and you believe a photo of yours is being used without proper permission, email privacy@byahebuilder.com with:

The URL of the page where the photo appears
A description of the photo (or a screenshot)
Your relationship to the photo (photographer, agency, etc.)

We’ll review and remove the photo within a reasonable time, typically within 7 days.

Travel information — important

The activities, prices, schedules, photos, and descriptions in the app are curated by us and contributed by other users. We try to keep them accurate, but:

Prices are estimates and may be out of date
Operating hours, availability, safety conditions, and access can change without notice
Activity operators are independent businesses we don’t control
Routes, distances, and travel-time estimates are rough — actual conditions vary

Always verify directly with the operator (price, opening hours, current availability, safety advisories) before traveling. Travel involves risks — especially water sports, hiking, motorbiking, and remote-area activities. Use the app’s recommendations as a starting point, not as a substitute for your own judgment, the operator’s instructions, and local advice.

We’re not a travel agent, tour operator, or booking service. We don’t sell tickets, take reservations, or process payments.

“As-is” service

The app is provided as-is, free of charge. We make no warranties — express or implied — about its accuracy, availability, completeness, or fitness for any specific purpose.

Limit of our liability

Because the app is free and we’re a small project, we limit our liability to the maximum extent allowed by Philippine law. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app — including (but not limited to) lost trips, missed flights, money spent based on our information, or harm during travel.

If we have to shut down

The app may change, lose features, or be discontinued. We’ll do our best to give you advance notice and a way to export your saved trips before any major change.

Termination

You can delete your account at any time.
We may suspend or remove your account if you violate these terms or use the app in a way that harms other users.
These terms continue to apply to your past use of the app even after your account ends.

Indemnification

If something you publish or do in the app causes a third party to bring a claim against us, you agree to cover the reasonable costs (legal fees, damages) — to the extent allowed by Philippine law.

Governing law

These terms are governed by the laws of the Republic of the Philippines. Any disputes go through Philippine courts.

Changes to these terms

We may update these terms. If a change materially affects your rights, we’ll bump the “last updated” date and notify users with active accounts by email.
